Capital Management, LLC (hereinafter referred to as the “Publisher”) is the
publisher of CypressHCM.com (hereinafter referred to as the “Site”) and is
committed to maintaining the privacy of information that you provide the Company
when using the Site.
1. Web Site Use
The
Publisher collects IP addresses and Web site usage information from you when you
visit the Site. This information helps us evaluate how our visitors use and
navigation of our Web site on an aggregate basis, including the number and
frequency of visitors to each Web page, and the length of their
visits.

sites operated by persons or entities other than Publisher (hereinafter referred

3. Candidates and Clients
The Publisher and the
Site offers people looking for positions to work (hereinafter referred to as
“Candidates”) and people and/or entities looking for people with certain
knowledge, skills, experience, expertise, and/or credentials to work in
positions within their entities (hereinafter referred to as “Clients”) the
opportunity to enter, retrieve, modify, review, search, select, upload, and
download certain information relative each other and/or to the above
activities. With respect to these activities, SHOULD YOU CHOOSE TO DO SO,
the Publisher and the Site will collect, and store any and all information that
you believe is important and relevant for Candidates (those people looking for a
position to work) and Clients (those people and/or entities looking for people
with certain knowledge, skills, experience, expertise, and/or credentials to
work in positions within their entities) including but not limited to
biographical information, demographic information, location, phone numbers,
email addresses, titles, compensation data, work history, position requirements,
documents containing personal/professional information, resumes, references,
educational information, and other information (hereinafter referred to as
“Candidate/Client Information”) as either Candidates and/or Clients may deem to
be important in the pursuit of their respective activities and which can be
entered, retrieved, modified, reviewed, searched, selected, uploaded, and
downloaded.
IF YOU ARE A CANDIDATE, AND YOU CHOOSE TO ENTER AND STORE
YOUR CANDIDATE INFORMATION WITH THE PUBLISHER AND THE SITE THEN ALL INFORMATION
(INCLUDING PERSONALLY IDENTIFIABLE INFORMATION) THAT YOU INCLUDE IN YOUR
CANDIDATE INFORMATION MAY BE VIEWED BY CLIENTS. IF YOU DO NOT WISH CERTAIN
PIECES OF PERSONAL INFORMATION TO BE ACCESSIBLE TO CLIENTS, THEN YOU SHOULD
REMOVE ANY AND ALL PERSONAL INFORMATION FROM THE SITE, INCLUDING ANY DOCUMENTS
THAT MAY CONTAIN SUCH INFORMATION (e.g. RESUME).
IF YOU ARE A CLIENT,
AND YOU CHOOSE TO ENTER AND STORE YOUR CANDIDATE/CLIENT INFORMATION AND
INFORMATION REGARDING YOUR ENTITY WITH THE PUBLISHER AND THE SITE, THEN ALL OF
THE INFORMATION (INCLUDING PERSONALLY IDENTIFIABLE INFORMATION) THAT YOU INCLUDE
IN YOUR CANDIDATE/CLIENT INFORMATION MAY BE VIEWED BY CANDIDATES. IF YOU
DO NOT WISH CERTAIN PIECES OF PERSONAL OR COMPANY INFORMATION TO BE ACCESSIBLE
TO CANDIDATES, THEN YOU SHOULD REMOVE ANY AND ALL PERSONAL OR COMPANY
INFORMATION FROM THE SITE, INCLUDING ANY DOCUMENTS THAT MAY CONTAIN SUCH
INFORMATION (e.g. COMPANY BROCHURE).
4. The Publisher’s Use of
Information
The Publisher may use Candidate/Client Information to provide
its services to Candidates and Clients including but not limited to services
that the Publisher deems in its sole discretion will be beneficial to Candidate
and/or Clients. These services may include contact with Candidates and
Clients to offer participation in surveys, opinion polls, introduce new
services, and update existing information. The Publisher reserves
the right to aggregate Candidate/Client Information (hereinafter referred to as
the “Publisher’s Aggregate Use Information”) into meaningful statistical data
that the Publisher believes will be useful and important information for itself,
Candidates, and Clients alike. The Publisher’s Aggregate Use
Information will not contain personally identifiable information of any one
Candidate and/or Client that is not considered information generally available
to the public.
5. Third Parties
The Publisher may engage with
companies who are network advertisers to deliver ads to you on our behalf.
The Publisher may also use third-party service providers to contact you on our
behalf, or facilitate some aspects of our Web site services, our business
services, or to provide services to you. These network advertisers and service
providers may be supplied with or have access to your personally identifiable
information solely for the purpose of providing these services to us or to you
on our behalf.
6. The Publisher’s Right To Disclose
Information
Except as specifically set forth in this Privacy Policy, the
Publisher will not share your personally identifiable information with any
person or entity unless you elect to allow the Publisher to share any
Candidate/Client Information with a person or entity that is not affiliated with
us. The Publisher may disclose and use personally identifiable information
in special circumstances such as the enforcement of our Intellectual Property
rights, in connection with the sale or transfer of some or all of the
Publisher’s assets including but not limited to the Site, and when the Publisher
believes in good faith that the law or regulatory agency requires it to do
so.
7. Cookies
When you utilize the Site, the Publisher and/or
third parties may pass cookies to your computer to enable Candidates, Clients,
and others to move more rapidly through the Site, linked web sites, and to
recognize repeat users. Cookies will remain on your computer
for a period of time and may have different and varying expiration dates.
You can choose not to receive the Publisher’s and the Site’s cookies by setting
your computer’s Internet Browser not to receive them.
8.
Security
The Publisher will take reasonable care to secure and safeguard
Candidate/Client Information. The Publisher is not responsible for
the invasion or hacking of its servers, hosting service, Site, and
Candidate/Client Information by outsiders, and their use of that
information. By using the Site, you thereby agree to waive any and all
damages that may result and hold the Publisher harmless there
from.
9. Policy Updates
The Publisher will notify all users of
the Site of any change to this Privacy Policy by posting a notice on the Home
Page of the Site.
